Your obligations, and how ProofMemo helps you meet them.
ProofMemo does not take on your duty. It helps you carry it out, in real time, to the best standard the technology allows today — on your own machine, with a record anyone can check.
A local workbench that records what you did, and shows what is missing
You run the file. ProofMemo reads the documents alongside you, checks the figures against each other, and produces a dated record of what was examined — including what it could not establish. Nothing leaves your machine to do it.
You bring the file
Payslips, statements, the fact-find, identity documents. They stay on your machine. ProofMemo reads them locally; there is no second copy sent anywhere.
It checks, the same way every time
Every step of the assessment runs identically on every file — collection, verification, position, the reasoning — and each step is labelled by who acts there and whether it touches the client's rights.
You get a checkable record
A dated account of what was examined and what is still missing or unreadable. You sign the judgement; the record evidences the steps you actually took, and anyone can verify it later.
The obligations, and what ProofMemo does for each
These are yours to discharge. ProofMemo is built to help you meet each one to a higher, more consistent standard than manual review, and to leave evidence that you did.
Best interests duty
Mortgage broker best interests duty, NCCP ActHow ProofMemo helps: The duty is yours and stays yours — the record declines to certify it on your behalf, by design. What ProofMemo does is make the evidence for it exist — a consistent, dated account of what was collected, checked and considered, so the reasonable steps behind your recommendation are visible rather than living only in memory.
Responsible lending — reasonable inquiries and verification
NCCP Act, responsible-lending obligationsHow ProofMemo helps: It reconciles the income and expense documents against each other and against the fact-find, flags what does not agree, and marks what could not be verified as unobservable rather than assuming it. Verification becomes something you can show, not just assert.
Record-keeping
NCCP / ASIC record-keeping expectationsHow ProofMemo helps: The output is the record. It is dated, tamper-evident, and reproducible from the same documents, so the file's history does not leave when a staff member does.
Automated-decision disclosure
Privacy Act APP 1.7, from 10 December 2026How ProofMemo helps: Where software is substantially and directly related to a decision about a person, the law will require disclosure. ProofMemo ships a broker-adoptable disclosure and a classification of every step by who acts and whether it touches the client's rights, so you can meet the new requirement with a record rather than a paragraph.
Privacy and data security
Privacy Act, Australian Privacy PrinciplesHow ProofMemo helps: The client's documents stay on your machine while they are read and assessed. The most sensitive fields are removed before any model sees them, and the complete list of routes data can take out of the system is checked on every build.
What it insulates you against
These are not hypotheticals. They are where a broker's exposure actually turns into a consequence, and where a dated record you own is the difference.
When the rules change under you
Legislation moves — SMSF borrowing, how lenders treat negative gearing before and after a change, what a client had to sign and when. What protects you is not your memory of it. It is a dated record of what your file looked like, and what your client had signed, at the moment you acted, under the rules that applied then. Try to reconstruct it a year later and the horse has bolted. Capture it at the time and the timing can never be turned against you.
An AFCA complaint
When a client dispute reaches the Australian Financial Complaints Authority, the question is what you actually did, disclosed and checked, and when. A record you hold and can produce on demand answers that. A memory, and a file that lived in a platform you do not control, does not.
A professional-indemnity question
Cover excludes fraud and it excludes clawback — the exposures that end practices. Proof that your own diligence was genuinely performed, and clean, is the line between an exposure you can defend and one you cannot insure your way out of.
Someone else's fraud
When a syndicate or a sub-aggregator collapses, good brokers get pulled down with it. The ones who come through are the ones who can show their own files were clean. That proof has to exist before the day you need it, and it has to be yours.
You hold the duty. We install the responsibility model around it.
Because ProofMemo runs locally and holds no client data, the responsibility for the file and the decision sits with you as the licensed human the law trusts. Issuing ProofMemo includes helping you stand up a responsibility model for your own practice, so who-does-what is written down and compliant.
You, the licensed representative
The credit recommendation and the best-interests duty are yours. ProofMemo never makes the professional call and never endorses one.
ProofMemo, in real time
Reads the documents, checks the figures, surfaces what is missing, and produces the record — helping you discharge the duty to a higher standard, faster.
The client's accountant and adviser
Suitability for a self-managed fund and tax questions route to the client's own licensed professionals. ProofMemo defers at that boundary.
The client
The automated-decision disclosure tells the client, in their own language, how software was involved. You issue it; ProofMemo supplies it.
What ProofMemo does not do
It does not make the decision. The decision path contains no model. Every step is labelled by who acts there, and the build fails if any step is found deciding on its own.
It does not take custody of your client's data. The system runs in your own browser and holds no second copy. Some tools take custody of people's information and, in effect, take on responsibility for it — we built the opposite.
It does not assume your duty. A professional duty cannot be delegated to software and should not be. The record says on its face that the judgement is yours.
